The purpose of this privacy policy is to set out the type of information Liver Foundation Limited ABN 65 821 709 952 (Liver Foundation/we/us) will collect and how we will hold, use and disclose your personal information, which you provide to us.
We respect the confidentiality and security of the personal information that you may provide to us. The way we manage your personal information is governed by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) established under the Privacy Act. Please note that this Privacy Policy does not extend your rights or Liver Foundation’s obligations beyond those defined in the Privacy Act. If there is any inconsistency between this Privacy Policy and the Privacy Act, this Privacy Policy shall be interpreted to give effect to and comply with the Privacy Act.
By visiting the Liver Foundation website or engaging with our services, you are accepting and consenting to the practices described in this privacy policy. The information we collect from you allows us to personalise and improve our services.
Whenever it is lawful and practicable, we may allow you the option of not identifying yourself when dealing with us. Personal information collected via the website
Every time you visit the website, Liver Foundation may collect information about you, including:
- the date and time of your visit to the Liver Foundation website;
- your IP address;
- the type of browser and operating system you are using; and
- any address of a recurring site and any website you are about to visit.
The above information provides Liver Foundation with details about how the website is used including the frequency and duration of visits, and which web pages you have accessed on the website. The information we collect will not personally identify you.

Promotions, marketing, E-newsletters
We may use information for internal marketing analysis, for example, to assess trends amongst the people and organisations we engage with or to measure the amount of traffic to our website. Disclosure
You consent that Liver Foundation may disclose your personal information:

Overseas disclosure
To provide customer support, perform back-office functions, store personal information, or to otherwise assist us in providing our services to you, we may engage third-party service providers that are located in a country other than that in which you are based. For example, our CRM management system stores data on servers located overseas. However, access is restricted so that data cannot be accessed by individuals internationally. Sensitive information is stored on a separate database with restricted access within Liver Foundation’s organisation and is only stored on servers located in Australia.
This does not lessen our obligation to protect your personal information, and we have implemented security measures to protect the security of your personal information. However, as with any transfer of data, there are still risks of data breaches. By requesting our services, you are explicitly consenting to the international transfer and processing of your personal information in accordance with this Privacy Policy, in full and informed knowledge of the risks associated with such transfers and processing.
Disclosure for analytics
We utilise the services of Google Analytics to track and improve usage of our website. Google Analytics is a web analysis service provided by Google, which utilises data collected to track and examine the use of our website, prepare reports on activities and share them with other Google services.
Google may use the data collected to contextualise and personalise the ads of its own advertising network. Protecting Your Personal Information
We take reasonable steps to:
- protect your information from misuse, interference, loss, and unauthorised access or disclosure;
- ensure staff are trained on privacy obligations;
- implementing multi-factor identification and restricted access to databases utilised within the organisation; and
- destroy or de-identify information when it is no longer required.
Your personal information may be stored in hard copy documents in locked filing cabinets, or in electronic format on a cloud-based databaseAccess will be restricted to those within Liver Foundation who require it to carry out their role within Liver Foundation.
Liver Foundation treats breaches of your privacy very seriously and any breach will result in disciplinary action being taken. If a data breach occurs that involves unauthorised access to, disclosure of, or loss of personal information and this is likely to result in serious harm to any individual about whom the information relates, we will comply with the data breach notification scheme in the Privacy Act. Liver Foundation ensures that our management of personal information is in accordance with this Privacy Policy and where applicable, the Privacy Act 1988 or the EU’s General Data Protection Regulation (the GDPR).
Accessing and Updating Your Personal Information
You have a right to request access to the personal information that we hold about you. The right to access is subject to certain exceptions allowed by law. Liver Foundation will, subject to applicable privacy laws, provide you with access to your information that is stored with us, and will deal with your request in a reasonable time frame, in most circumstances within 30 days.
Please be aware, in some circumstances the law permits Liver Foundation to refuse your request to provide you with access to your personal information. In addition to privacy laws, you may have rights to access your personal information contained in certain Liver Foundation documents. You can apply for access through the Freedom of Information Act 1982 or relevant state and territory legislation
If you believe that any information, we hold about you is incorrect, out of date, irrelevant or misleading we will take reasonable steps to correct this information once it is brought to our attention. If you wish to access your information, please contact the Privacy Officer on the details listed below.
Retention of Data
We retain personal and sensitive health information for as long as it is necessary to fulfil the purposes for which it was collected, including to comply with applicable legal, regulatory, and reporting obligations.
In particular:
- health records and related information are retained in accordance with relevant state and territory legislation;
- if you are a participant in our health programs or have engaged with our services, we may retain your records for a minimum period of 7 years from the date of last contact, or longer where required by law; and
- if you are a minor at the time of service, we may retain your information until you turn 25 years of age or as otherwise required by law.
Once personal information is no longer required for any lawful purpose, we will take reasonable steps to securely destroy or permanently de-identify the information.
Data Retention
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
International Users
If you are located outside Australia and choose to provide your personal information to us, your personal information will be processed in Australia and in accordance with this Privacy Policy.
Changes to this Privacy Policy
Liver Foundation may change this Privacy Policy at any time. If we change this Privacy Policy, those changes will be set out in that revised policy and displayed on our website, so that you have immediate access to the changes. Lodging a Complaint
If you have a complaint about how we handled your personal information or about any decision to refuse access or correction of your personal information, please contact us using the Contact Details below. We will request that you lodge your complaint in writing.
We will acknowledge receipt of your complaint as soon as possible after receiving your written complaint. We will then investigate the circumstances of your complaint and provide you with a response within a reasonable timeframe, in most circumstances within 30 days.
